Assuming you are conscious and able to move about the scene, there are a number of things you can and should do to protect your interests after an automobile crash. First, determine if anyone in your vehicle or other vehicles are injured. Call 911 and report the crash and any injuries. Turn on your emergency flashers and set out safety cones, reflectors or flairs, if you have them.
Next, provide assistance and comfort to anyone who was injured in the accident. If others make statements regarding the collision, be sure to take note of that, and if possible write it down, making sure to get their name, address and telephone number. If you have a pencil and paper, take note of the way in which the vehicles collided, where they came to a stop in relationship to each other and the lanes of traffic in which you were traveling. Be sure to note the names any and all witnesses to the scene. If you can’t get the name of drivers and passengers of other vehicles that stop or slow down after the accident, attempt to get their license plate numbers.
Be sure to exchange names, address, drivers license numbers, and insurance information with the other driver. Report the accident to your insurance agent as soon as possible, even if you have to contact him or her from the scene of the collision.
Don’t assume that you or your vehicle have suffered no damage just because it is not immediately evident at the scene. Physical injuries may not reveal themselves until hours after the collision. Similarly, the frame and underlying structure of your vehicle may be damaged in such a way that the damage is not immediately evident at the scene of the collision. Don’t make any statements to the effect that there is no injury or damage as a result of the collision until you have had a reasonable opportunity to assess the situation.
While a police officer may come to the scene of the collision and take a report, it is important that you take steps to preserve evidence that may be useful later, should you need to file a claim or defend yourself in a lawsuit. If you have the ability to take photos at the scene, take photos of the vehicles, the parties and witnesses if possible, the pavement showing skid marks or the lack thereof, the speed limit signs, stop signs or stop lights, and the overall weather and visibility at the scene. While you should not interfere with the investigation, you can certainly help by making a clear and concise statement to the police officer, directing him or her to other people you believe to be witnesses.
If you are injured, do not refuse to go to the hospital to be checked out, even if they want to put you in an ambulance. Failure to seek immediate medical attention is often a defense lawyers best attack on a person who later files a claim for a crash related injury. If you have any reason at all to believe you have suffered an injury that is significant enough to file a claim, go to the hospital and have yourself check out.
